Ministério da Cidadania, AGU, Caixa e Dataprev celebram novo acordo para aperfeiçoar análises do Auxílio Emergencial
Medidas buscam o aprimoramento do sistema e o esclarecimento sobre ações já adotadas pelo Governo Federal para agilizar a concessão do benefício
AAdvocacia-Geral da União (AGU) celebrou, em conjunto com o Ministério da Cidadania, a Caixa Econômica Federal e a Dataprev (empresa pública responsável pelo sistema de cadastro dos usuários), mais um acordo judicial de abrangência nacional para aperfeiçoar a análise de pedidos de pagamento do Auxílio Emergencial. Desta vez, no âmbito de ação civil pública movida pelo Ministério Público Federal para questionar supostas falhas relatadas pelos usuários na utilização do aplicativo do programa.
Na semana passada, o Governo Federal já havia assumido em outro acordo o compromisso de concluir a análise de pedidos do Auxílio Emergencial em até 20 dias corridos. Agora, União, Caixa e Dataprev assumiram outros sete compromissos em acordo homologado pela Justiça Federal de Minas Gerais.
Manter a eficiência dos sistemas operacionais durante todo o fluxo de análise e concessão do Auxílio Emergencial, aperfeiçoando-os regularmente.
Permitir ao usuário contestar pedidos rejeitados e formular novo requerimento, bem como informar à Justiça e ao MPF, no prazo de dez dias, as alterações realizadas no aplicativo para solucionar eventuais inconsistências.
Atualizar de forma permanente os bancos de dados oficiais, evitando defasagem de informações sobre situação de desemprego.
Tornar mais claro e apresentar motivação adequada para os atos de indeferimento.
Substituir a expressão “Dados Inconclusivos” pela opção “Realize Nova Solicitação” nos casos em que o benefício não for efetivamente indeferido.
Realizar esforços para divulgar os motivos de negativa das solicitações.
Prestar informações complementares sobre o objeto da ação ao MPF e à Defensoria Pública da União em até 72 horas, caso provocados em juízo ou na esfera administrativa.
O novo acordo também contém uma série de esclarecimentos sobre as medidas já adotadas pelo Governo Federal para solucionar os problemas relatados pelos usuários, como a possibilidade de o cidadão alterar os dados cadastrais, na hipótese de o programa identificar que os dados fornecidos são inconclusivos, e uma maior clareza sobre o fluxo do repasse dos benefícios processados por outros bancos.
Segundo o procurador-chefe da União em Minas Gerais, Bráulio Lisboa Lopes, a nova conciliação amplia o escopo dos aperfeiçoamentos no sistema que já haviam sido pactuados com a Defensoria Pública. “Ficou estabelecida a disponibilização de um sistema em que o cidadão poderá consultar o status da sua solicitação, verificar se foi eleito, os motivos que levaram à eventual inelegibilidade, além de outras medidas essenciais à maior transparência e agilidade da operacionalização do programa governamental”, detalha Lopes, acrescentando que o acordo deve contribuir ainda mais para a redução do número de ações judiciais discutindo o pagamento do Auxílio Emergencial.
Além da Procuradoria da União em Minas Gerais, atuou no acordo a Consultoria Jurídica do Ministério da Cidadania.
